These Terms of Sale govern all sales of products and services provided by Avant Printing, whether ordered online, by email, telephone, or in person.
1. Acceptance
By placing an order, the customer agrees to these Terms of Sale. Any conflicting customer purchase order terms are rejected unless accepted in writing.
2. Quotes & Estimates
Quotes are valid for 30 days unless otherwise stated. Prices may change if specifications, quantities, materials, freight, taxes, or customer requirements change.
3. Orders
An order is accepted only after Avant Printing confirms it. We may decline orders for legal, technical, credit, capacity, copyright, or quality reasons.
4. Payment
Unless credit has been approved in writing, payment in full is required before production begins. Deposits may be required for custom work, framing, scanning, large-format printing, apparel, or special-order materials.
5. Customer Artwork
The customer represents that they own or have permission to reproduce all submitted content and agrees to indemnify Avant Printing against copyright, trademark, privacy, publicity, or other intellectual-property claims.
6. Proof Approval
Production will not begin until required proofs are approved. Approval confirms that layout, spelling, dimensions, crops, and content are correct. Customer-approved errors are the customer’s responsibility.
7. Color & Manufacturing Tolerances
Exact color matching cannot be guaranteed because of differences in media, inks, printers, coatings, lighting, monitors, and manufacturing processes. Minor trimming, registration, quantity, and color variations are commercially acceptable.
8. Production Schedule
Production times are estimates unless expressly guaranteed in writing. Delays caused by customer changes, file problems, equipment failures, weather, carriers, suppliers, or other events beyond our control extend delivery dates accordingly.
9. Shipping & Pickup
Risk of loss transfers when products are delivered to the carrier or picked up by the customer. Shipping dates are estimates. Customers should inspect shipments promptly and report damage immediately.
10. Returns, Reprints & Credits
Because products are custom manufactured, returns are generally not accepted. Verified manufacturing defects reported promptly may be corrected by reprint, repair, replacement, or credit at Avant Printing’s option.
11. Storage
Completed jobs, customer-supplied materials, and digital files may be discarded after a reasonable retention period unless other arrangements are made.
12. Fine Art, Framing & Restoration
Because these services often involve irreplaceable originals, Avant Printing exercises reasonable care but is not responsible for pre-existing damage, hidden defects, or conditions beyond its control.
13. Limitation of Liability
To the fullest extent permitted by law, Avant Printing’s total liability arising from any order shall not exceed the amount paid for the affected order. Avant Printing shall not be liable for indirect, incidental, special, consequential, or lost-profit damages.
14. Force Majeure
Avant Printing is not liable for delays or failure to perform caused by events beyond its reasonable control including natural disasters, labor disputes, supplier shortages, transportation interruptions, utility failures, cyber incidents, governmental actions, or similar events.
15. Governing Law
These Terms are governed by the laws of the State of California. Venue for disputes shall lie in the appropriate state or federal court located in California unless otherwise required by law.
16. Changes
Avant Printing may revise these Terms of Sale from time to time. The version in effect when an order is accepted governs that transaction.
